This Privacy Policy explains how Bharat Agrolink, a platform owned and operated by Agrolink Manufacturing Private Limited (referred to as "the Company," "we," "our," or "us"), collects, uses, stores, processes, and protects the information of any individual or entity who accesses, browses, or uses our website, mobile applications, and other online services, as well as during interactions with our customer service channels (collectively referred to as "Users," "Sellers," "Buyers," "you," or "your").

The Company owns, operates, and manages the domain name https://bharatagrolink.com and its associated software applications designed for wireless devices such as smartphones and tablets, as well as desktop or laptop computers (collectively referred to as the "Platform" or "Application").

The Platform provides Users with seamless access to a range of agriculture-related marketplace services, including but not limited to listing, marketing, purchasing, and selling agricultural products such as seeds, fertilizers, pesticides, agri-machinery, accessories, and other related goods and services, as well as knowledge-based content for farmers and planned agri-consultancy services (collectively referred to as the "Services"). These Services are governed by the Platform's applicable Terms of Use, available at https://seller.bharatagrolink.com/terms-of-use for Seller or https://bharatagrolink.com/terms-and-conditions for users.

We are committed to safeguarding the personal information shared with us by Users and handling it in compliance with applicable privacy standards and legal frameworks under Indian law, including the Digital Personal Data Protection Act, 2023, and the Information Technology Act, 2000 along with its applicable rules.

We do not knowingly collect or solicit personal information from individuals under the age of 18. If you are under 18, please refrain from attempting to register for the Services or providing any personal information to us.

If we become aware that personal information has been collected from an individual under the age of 18, we will take immediate steps to delete such information. If you believe that a minor under the age of 18 has provided personal information to us, please contact us at info@bharatagrolink.com for prompt resolution.

CONSENT

By accessing, browsing, registering on, or otherwise using the Platform or the Services, each User (including Sellers and Buyers) acknowledges that they have read, understood, and expressly agreed to be bound by this Privacy Policy. By providing such consent, the User authorizes the Company to collect, use, store, process, share, transfer, and disclose their Personal Information in accordance with this Privacy Policy and applicable law.

The User understands and agrees that certain Personal Information is essential for the performance of the Services (including account creation, order processing, delivery, payments, KYC, regulatory compliance, and fraud prevention). Withdrawal of consent for such essential processing may render the User unable to access or use the Platform.

The Company may also process Personal Information where such processing is required to comply with applicable laws, legitimate business interests, regulatory obligations, or lawful requests from government authorities, irrespective of consent, in accordance with the Digital Personal Data Protection Act, 2023.

The Company reserves the right to revise, modify, or update this Privacy Policy at its sole discretion. Any changes shall become effective upon being posted on the Platform. Users are advised to review this Privacy Policy periodically. Continued access or use of the Platform after such updates shall constitute the User's deemed acceptance of the modified Privacy Policy.

Users may withdraw consent, request access to their Personal Information, seek correction, or request deletion by contacting info@bharatagrolink.com. The Company may require identity verification and supporting documents before acting on such requests. Users acknowledge that withdrawal of consent or deletion requests may require closure of their Bharat Agrolink account, and certain information may continue to be retained as required under applicable law (including tax, accounting, audit, fraud prevention, and regulatory compliance).

Users further acknowledge that withdrawal of consent shall not affect the legality of processing carried out prior to such withdrawal.

If the User does not agree with this Privacy Policy or any modifications hereafter, they must immediately discontinue use of the Platform and refrain from providing any further Personal Information to the Company.

If the User is below 18 years of age, consent must be provided by a parent or lawful guardian. The Company does not knowingly collect Personal Information from minors without such verifiable parental consent.

COLLECTION OF PERSONAL DATA

To enable Users (including Sellers and Buyers) to register, access, and avail the features, benefits, and Services offered on the Platform, the Company may collect certain categories of information that constitute "Personal Information" or "Sensitive Personal Data or Information" as defined under:

  • Regulation 3 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011;
  • The Digital Personal Data Protection Act, 2023;
  • The Prevention of Money Laundering Act, 2002 (where applicable); and
  • Any other applicable data privacy, financial, agricultural, and e-commerce regulations.

Personal Data may be collected directly from the User, automatically when the User interacts with the Platform, or through third-party service providers as part of lawful verification, fraud prevention, and transaction processing.

The categories of Personal Information that we may collect include, but are not limited to, the following:

  • Full Name

  • Gender
  • Nationality
  • Marital Status
  • Profile Photograph
  • Government-issued identification documents, including Aadhaar, PAN, Passport, Driving Licence, or Voter ID
  • KYC information as required under law or platform policies

  • PIN/Postal code
  • Primary and alternate phone numbers
  • Email address
  • Geolocation data (precise and/or approximate)

  • UPI or payment wallet details

  • Loan or credit information (if applicable for financing services)
  • Tax identification details including GSTIN and PAN (mandatory for Sellers)
  • Other financial data required for payouts, refunds, settlements, reconciliations, and dispute resolution

4. Business & Regulatory Information (For Sellers)

  • Business/legal entity name
  • Registered office and operating address
  • Business licenses and statutory registrations required under applicable agricultural and commercial laws, including but not limited to:
    • Seeds Act
    • Insecticides Act
    • Fertilizer Control Order (FCO)
    • FSSAI regulations
  • GST registration certificate
  • Trade licence, Udyam/UDYOG Aadhaar, or equivalent documents
  • Compliance certificates, quality documents, and approvals required for product listing and sale

5. Device and Technical Information

Collected automatically when a User uses the Platform:

  • Access to device camera, microphone, or storage (for uploading documents, KYC, and authentication)
  • Device make, model, operating system, and software version
  • IMEI and unique device identifiers
  • IP address, browser type, language, and network information
  • App usage data, crash logs, and diagnostic information
  • Precise and/or coarse location, where enabled
  • Device security attributes and permissions status

This information is required for onboarding, authentication, fraud prevention, security monitoring, digital signatures, and compliance verification.

6. Contact List (Optional) & UPI Services

With the User's specific and explicit consent, we may access the User's contact list solely for:

  • Enabling UPI-based transactions
  • Payment-related functionalities (e.g., pay-to-contact, UPI collect requests)

This consent is optional, and such access is never used for digital lending or unsolicited communication.

7. Financial and Transactional Data

We may collect information related to transactions made on or through the Platform, including:

a. Payment Information

  • Payment method and mode
  • UPI, wallet, bank mandate, or standing instruction details
  • Billing address
  • Authentication details (e.g., masked card data, tokenized card information)

b. Transaction Details

  • Transaction date, time, and amount
  • UTR/transaction reference numbers
  • Order history and purchase patterns
  • Refunds, cancellations, chargebacks, and dispute records
  • Settlement and payout information (for Sellers)

8. Cookies and Similar Technologies

We may use cookies, web beacons, pixels, local storage, and similar technologies to:

  • Identify browser or device
  • Authenticate Users
  • Maintain login sessions
  • Enable notifications
  • Enhance performance and security
  • Improve user experience and analytics

Users may manage cookie preferences through browser settings; however, disabling essential cookies may limit Platform functionality.

9. Data of Minors

The Platform is not intended for Users below 18 years of age. If a minor accesses the Platform, we may require verifiable parental or guardian consent in accordance with the DPDP Act, 2023. If such consent cannot be verified, the Company may delete or restrict access to the minor's Personal Data.

USE OF PERSONAL INFORMATION

The Company uses the Personal Information collected from Users (including Sellers and Buyers) to operate, manage, secure, and improve the Platform and to provide a seamless, safe, and personalized experience. Access to login credentials, registration data, and all other Personal Information is strictly controlled and permitted only in accordance with internal security protocols, confidentiality policies, role-based access controls, and applicable legal requirements.

Personal Information may be used for the following purposes:

1. Account Creation, Verification, and Management

  • To create, authenticate, verify, operate, and maintain User accounts (including Buyer and Seller accounts).
  • To undertake KYC verification, business verification, or regulatory checks required under applicable laws.
  • To ensure lawful onboarding of Sellers and Buyers and maintain account integrity.

2. Enabling Platform Functionalities and Services

  • To allow Users to list, purchase, advertise, and sell products on the Platform.
  • To support agricultural advisory services, content access, digital tools, customer support, and other Platform features.
  • To enable payments, settlements, refunds, invoicing, reconciliation, and transaction processing.
  • To ensure smooth interaction between Users, Sellers, logistics partners, and service providers.

3. Platform Enhancement and Feature Development

  • To develop, test, enhance, and launch new features, functionalities, modules, and tools.
  • To continuously improve user interface, platform performance, and operational workflows.
  • To perform A/B testing, quality evaluation, and service optimization.

4. Communications and Notifications

  • To send important communications regarding account activity, orders, payouts, refunds, logistics updates, and customer support.
  • To notify Users of policy changes, regulatory updates, new features, terms updates, service alerts, and compliance requirements.
  • To send legally required notices, transactional messages, and service-critical communications (these cannot be opted out of).

5. Personalization, Recommendations, and Marketing

  • To personalize the User experience, including product recommendations, relevant listings, advisory content, and marketplace insights.
  • To conduct marketing, promotional activities, offers, and campaigns in compliance with applicable laws and subject to User consent, where required.
  • Users may opt out of non-essential marketing communications at any time.

6. Analytics, Insights, and Business Intelligence

  • To compile, analyze, and process data relating to User behavior, browsing patterns, product demand, transaction volumes, and operational metrics.
  • To generate insights that support marketplace optimization, supply-demand planning, vendor performance analysis, fraud detection, and product category improvements.
  • To create anonymized or aggregated datasets for analytics, internal reporting, and business strategy.

7. Identity Verification, Risk Management, and Security

  • To conduct identity verification, fraud monitoring, AML checks, chargeback analysis, and risk assessments.
  • To detect, prevent, and investigate unauthorized access, prohibited activities, fraudulent behavior, and security threats.
  • To maintain the safety, reliability, and integrity of the Platform, its infrastructure, Users, and associated services.

8. Legal and Regulatory Compliance

  • To comply with applicable laws, including laws governing agricultural inputs, product licensing, eCommerce compliance, GST and tax requirements, KYC/AML obligations, consumer protection, and data protection mandates.
  • To respond to lawful requests, notices, audits, regulatory reporting, or directions issued by government or regulatory authorities.
  • To maintain books of account, transaction logs, and statutory records as required by law.

9. Customer Support, Dispute Resolution, and Grievance Handling

  • To address queries, complaints, grievances, and support requests raised by Users.
  • To assist in handling disputes involving orders, payments, deliveries, returns, cancellations, and Seller-buyer issues.
  • To ensure timely and efficient grievance redressal in compliance with applicable consumer and eCommerce guidelines.

10. Other Legitimate Business Purposes

  • To enforce the Terms of Use, Seller Policies, Buyer Policies, and other contractual obligations.
  • To support internal audits, operational efficiency, record-keeping, and internal governance.
  • To protect the rights, interests, and safety of the Company, Users, and the Platform ecosystem.

ACCESS AND UPDATE YOUR PERSONAL INFORMATION

1. User Ownership of Personal Information

The Personal Information provided to the Platform remains the property of the User. The Company processes such information strictly in accordance with this Privacy Policy and applicable legal requirements.

2. Access and Correction of Information

Users may access, review, and update their Personal Information at any time by logging into their Platform account and making the necessary changes. Certain information—such as KYC details, tax identifiers, bank account details, and regulatory documents—may require the User to submit supporting documentation to verify the authenticity of the requested changes.

For the safety and security of User data, and to comply with legal and regulatory obligations, the Company may require additional identity verification before providing access to, or updating, any Personal Information.

3. Withdrawal of Consent

Users may withdraw the consent previously granted for the collection, use, or processing of their Personal Information by submitting a request through the Platform or by contacting the Company directly.

However, Users acknowledge that:

  • Withdrawal of consent may limit or prevent access to certain features or essential functionalities of the Platform.
  • Certain information cannot be deleted or withdrawn where retention is required under applicable law (including tax, accounting, fraud prevention, or regulatory compliance).
  • Withdrawal of consent may require the User to permanently delete their Bharat Agrolink account.

Upon account deletion, Users will no longer be able to access the Services, and the Company may retain certain records as required or permitted by law.

4. Responsibility for Account Security

Users are solely responsible for maintaining the confidentiality, security, and integrity of their login credentials, including passwords, OTPs, authentication methods, and access devices. The Company shall not be liable for unauthorized access resulting from the User's failure to secure their credentials.

If a User believes that their account or Personal Information has been compromised, they must:

  • Immediately reset their password; and
  • Notify the Company at grievance@bharatagrolink.com for prompt assistance and security review.

DISCLOSURE AND TRANSFER OF PERSONAL INFORMATION

By accessing or using the Platform, Users expressly consent to the Company sharing, disclosing, transferring, or otherwise making available their Personal Information to third parties strictly in accordance with this Privacy Policy, applicable law, and the principles of purpose limitation and data minimization.

1. Disclosure to Third Parties for Service Enablement

We may share a User's Personal Information with the following categories of third parties, solely for the purpose of enabling, operating, maintaining, improving, and securing the Services:

  • Payment processors, banks, UPI partners, and financial institutions
  • Logistics partners, delivery agents, shipping providers, and warehouse partners
  • KYC/AML verification and compliance service providers
  • Customer support, grievance redressal, and communication service providers
  • Cloud hosting providers, IT infrastructure partners, data storage vendors
  • Analytics, fraud detection, cyber-security, and risk management companies
  • Technology vendors, software integrators, and operational partners
  • Insurance providers for shipment protection or transit loss coverage
  • Professional advisors (legal, audit, tax, regulatory consultants)

Personal Information is shared strictly on a need-to-know basis and only to the extent required for these third parties to perform their contractual or legally mandated obligations.

Within the Company:

  • Access to Personal Information is role-based, limited only to authorized personnel.
  • All employees are required to comply with confidentiality, privacy, and data protection obligations.

This information is used purely for analytics, industry benchmarking, improving services, and lawful business purposes.

4. Legal, Regulatory, and Compliance Disclosures

Such disclosures shall be limited to what is legally necessary.

Any opinions, information, advice, representations, or content provided by third parties are solely those of their respective authors and do not reflect the Company's views or policies.

4. User Responsibility for Third-Party Engagements

Use of third-party services is at the User's discretion and risk.

DISCLAIMER OF INFORMATION

1. User-Generated and Third-Party Content

The Company does not control, verify, moderate, or endorse any content, messages, listings, product descriptions, images, materials, advice, or information posted, uploaded, transmitted, or otherwise made available on the Platform by any User, Seller, Buyer, or third party ("Third-Party Content"). All such content is the sole responsibility of the individual or entity from whom it originates.

Accordingly, the Company expressly disclaims any and all liability arising out of or in connection with:

  • The accuracy, completeness, legality, authenticity, or reliability of Third-Party Content;
  • Any misrepresentations, false claims, pricing discrepancies, or regulatory non-compliance by Sellers;
  • Any products, goods, or services offered, listed, advertised, or supplied by Sellers or third-party providers;
  • Any interactions, communications, disputes, or transactions between Users, Sellers, Buyers, or third parties;
  • Any loss, damage, injury, or dissatisfaction arising from reliance on Third-Party Content.

Users agree that they access, rely on, or engage with any such content or third-party offerings entirely at their own risk.

2. Waiver and Release of Claims

By using the Platform, the User agrees to waive any claims, complaints, demands, causes of action, or legal proceedings against the Company that arise from or relate to:

  • User-to-User or User-to-Seller interactions;
  • Third-party products, services, or conduct;
  • Information posted by other Users or third parties;
  • Errors, omissions, or inaccuracies in Third-Party Content.

To the extent a waiver is not enforceable under applicable law, the User agrees to fully release the Company from any liability relating to such matters.

3. User Responsibility for Submitted Information

Users are solely responsible for ensuring that all information they submit, upload, or provide on the Platform—including but not limited to KYC documents, business licenses, product details, bank information, regulatory certificates, and communication content—is accurate, truthful, complete, lawful, and not misleading.

The Company shall not be liable for any consequences resulting from:

  • Inaccurate or incomplete information provided by a User;
  • Fraudulent or falsified submissions;
  • Invalid, expired, or non-compliant documents;
  • Data or content that violates laws, regulations, or Platform policies.

4. Indemnification

The User agrees to indemnify, defend, and hold harmless the Company, its directors, officers, employees, agents, and affiliates from and against any claims, losses, liabilities, penalties, damages, or expenses (including reasonable legal fees) arising from or relating to:

  • Any inaccurate, misleading, unlawful, or incomplete information submitted by the User;
  • Any breach of this Privacy Policy, Terms of Use, or applicable law;
  • Any claims made by third parties arising out of the User's conduct, submissions, or interactions on the Platform.

This indemnity obligation shall survive the User's cessation of Platform usage, account deletion, or termination of services.

DATA RETENTION, STORAGE & SECURITY PRACTICES

The Company retains Personal Information only for as long as necessary to fulfil lawful and operational requirements, including:

  • Up to 8 years for GST, accounting, and audit records
  • Up to 5 years for KYC and financial documents
  • Until resolution of disputes or legal proceedings
  • While the User account remains active

After expiry of the applicable period, data is securely deleted, anonymized, or archived.

The Company uses reasonable technical and organizational safeguards such as encryption, secure servers, access controls, and regular monitoring. However, no system is entirely secure, and the Company is not liable for incidents beyond its reasonable control.

Personal Information is stored on secure servers in India or other legally permitted jurisdictions under confidentiality and contractual protections.

USER RIGHTS, CONSENT & CONTROL OF PERSONAL INFORMATION

Subject to verification and legal requirements, Users may:

  • Access their Personal Information
  • Request correction or updates
  • Withdraw consent for non-essential processing
  • Request deletion, subject to legal retention requirements
  • Submit grievances to the Grievance Officer
  • Appeal outcomes to the Data Protection Board of India
